The firm’s litigation practice covers the full spectrum of business and commercial litigation including, but not limited to, matters involving securities, real estate, employment and labor disputes and the entire gamut of contractual disputes. We represent clients in state, federal and bankruptcy courts, before federal, state and local administrative agencies and in arbitration proceedings.
Corporate Officer and Director Litigation.
We have litigated a number of federal and state actions involving issues of corporate officer and director liability, achieving both the dismissal of claims brought against such persons as defendants, and the payment of multimillion dollar settlements in claims brought against corporate officers and directors and their insurance carriers.
Bankruptcy and Insolvency Litigation.
We regularly represent several multinational manufacturing and commercial financial service companies in commercial litigation and bankruptcy matters throughout the State of California, as well as a major non-profit corporation serving the credit and financial community in cases involving assignments for the benefit of creditors and other insolvency matters.
We have a particular litigation expertise in the general assignment area, including the representation of an assignee in a precedent-setting case which resulted in the largest recovery for creditors in the history of the consumer electronics industry.
We have also represented creditors’ committees, financial institutions and trade creditors in other insolvency cases relating to financial services. Our practice includes the litigation and trial of dischargeability matters on behalf of creditors in the bankruptcy courts throughout California, including actions involving fiduciary misconduct, fraud and embezzlement.
Complex Business Litigation.
Our experience and expertise in this area includes the successful handling of a variety of business matters for financial institutions and holding companies thereof and individuals in areas including commercial and contractual disputes, corporate officer-director and other professional liability cases, federal regulation of commerce, securities fraud, federal and state unfair competition claims, and insurance coverage and bad faith litigation, including for receivers, assignees and other fiduciaries in insolvency matters.
Appellate Practice.
We regularly handle appeals in both the federal and state court system, including cases we have litigated in the trial court, and in seeking to reverse adverse results suffered by clients in cases tried or litigated by other firms.
Within the last two years we have successfully litigated appeals to the California Courts of Appeals on issues involving corporate loans to shareholders, the rights of a corporate assignor to sue an assignee for the benefit of creditors, and corporate officer indemnity rights in the insolvency context. We have also served as counsel for a successful petitioner persuading the United States Supreme Court to grant review of a major decision of the Ninth Circuit Court of Appeals involving important issues of federal attorneys fees law, and appeared on behalf of amicus curiae in matters before the California and United States Supreme Courts.
